Terms of Use for Zakatek

These Terms of Use ("Terms") govern your use of Zakatek ("we", "us", "our"), accessible from https://zakatek.app, including making donations, enrolling in recurring giving, and creating or managing projects. By using Zakatek or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the platform.

1. About Zakatek
Zakatek is an online platform that connects donors with organisations running charitable projects, including Zakah and Sadaqah initiatives. Zakatek provides the technology for donations and project management; the organisations listed on Zakatek run their projects and are responsible for delivering them.
2. Eligibility and Accounts
You must be at least 18 years old, or the age of majority where you live, to create an account or make a donation.
You agree to provide accurate information and keep it up to date.
You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at operations@zakatek.app if you suspect unauthorised use.
We may suspend or close accounts that break these Terms, provide false information, or put donors, organisations, or the platform at risk.
3. Donations
Donations are voluntary gifts to the organisation and project you choose. You are not buying goods or services, and you receive nothing in return.
Zakatek does not charge donors a platform fee. Standard payment processing fees apply and are factored into project goals.
Once a donation is processed, it is final except as described in Section 6 (Refunds).
Whether a donation is tax deductible depends on the receiving organisation and the tax rules where you live. Zakatek does not provide tax advice.
4. Payments and Currency
Card donations are processed by Square. Card details are entered directly with Square and are never stored on Zakatek's servers.
Card donations are charged in US dollars (USD). Amounts shown in other currencies are estimates based on daily market exchange rates. Before you pay, we show the exact USD amount and an "up to" estimate in your currency. Your bank or card issuer may convert the USD charge at its own rate and may add its own fees; these are outside our control.
If the exchange rate changes between showing you the amount and processing your payment, we will show you the updated USD amount and ask you to confirm before charging.
M-Pesa donations are processed through NCBA and are charged in Kenyan shillings (KES).
5. Recurring Giving
If you enrol in recurring giving, you authorise us, through Square, to charge your saved payment method at the frequency you choose until you cancel.
You can pause, resume, or cancel recurring support at any time from your account. Cancellation stops future charges; it does not refund charges already made.
If a recurring payment fails, we may retry it or pause your support and let you know.
6. Refunds
Donations are generally non-refundable. We will consider a refund where a donation was made in error, for example a duplicate payment, an incorrect amount, or a payment you did not authorise.
To request a refund, contact us at operations@zakatek.app or through our official social media channels, with the date, amount, and the email address used for the donation. Please contact us as soon as possible.
Approved card refunds are issued through Square to the original payment method, in US dollars. Because your bank converts currencies at its own rates, the amount returned in your currency may differ from the amount originally debited.
Refunds may not be possible once funds have been paid out to the organisation. If you dispute a charge with your bank, we may share relevant transaction details with Square and the bank to resolve it.
7. Zakah Guidance and Calculations
Zakatek's Zakah tools, including nisab values and calculators, are provided for guidance. Nisab values are calculated daily from market prices of gold and silver using scholar-approved weights.
Calculations depend on the information you enter and on market data that can change. They are not a religious ruling. For questions about your personal Zakah obligation, please consult a qualified scholar.
Organisations are responsible for ensuring that Zakah funds they receive are distributed to eligible recipients.
8. Organisations and Campaign Creators
If you create or manage projects on Zakatek, you also agree that:
Information about your organisation and projects is accurate, complete, and not misleading.
You will use donations for the purposes described in the project and keep donors informed through updates.
You hold any registrations, licences, and approvals required to raise and distribute funds, and you will comply with applicable laws, including anti-money laundering, sanctions, and tax rules.
Bank and payout details you provide are correct and belong to your organisation.
We may review, pause, or remove projects, and withhold or delay payouts, where we reasonably suspect fraud, misuse of funds, or a breach of these Terms.
9. Acceptable Use
You agree not to:
Use Zakatek for fraud, money laundering, terrorist financing, or any unlawful purpose.
Use stolen or unauthorised payment methods.
Post content that is false, hateful, infringing, or harmful.
Interfere with the platform's security or operation, or access accounts or data without permission.
10. Content and Intellectual Property
The Zakatek name, logo, and platform are owned by Zakatek. Organisations keep ownership of the content they upload, and grant Zakatek a non-exclusive licence to display it on the platform and to promote their projects.
11. Third-Party Services
Zakatek relies on third parties, including Square and NCBA for payments. Your use of those services may also be subject to their own terms. We are not responsible for their availability or actions.
12. Disclaimers
Zakatek is provided "as is" and "as available". We do not guarantee that the platform will be uninterrupted or error-free, or that any project will achieve its goals. We do not guarantee how organisations use funds, although we take reasonable steps to verify the organisations we list.
13. Limitation of Liability
To the fullest extent permitted by law, Zakatek is not liable for indirect, incidental, or consequential losses arising from your use of the platform. Our total liability for any claim relating to a donation is limited to the amount of that donation.
14. Governing Law and Disputes
These Terms are governed by the laws of the United States and the State of Missouri, without regard to conflict-of-law rules. Before starting any formal claim, please contact us at operations@zakatek.app so we can try to resolve the issue informally. Nothing in these Terms limits rights you have under the consumer protection laws of the country where you live.
15. Changes to These Terms
We may update these Terms. Material changes will be notified via email or a prominent notice on our website. The "Effective Date" at the top indicates when the Terms were last revised. Continuing to use Zakatek after a change means you accept the updated Terms.
